These Terms of Service ("Terms") govern your use of the HenovaFresh Ltd website and services. By accessing our platform or placing an order, you agree to be bound by these Terms.
1. About HenovaFresh
HenovaFresh Ltd is a technology-driven nutrition platform that operates smart automated vending machines dispensing fresh smoothies. We operate in the United Kingdom and Nigeria.
2. Using Our Platform
You must be at least 16 years old to create an account and use our services. By registering, you confirm that all information provided is accurate and up to date. You are responsible for maintaining the security of your account credentials.
3. Orders and Payments
All orders placed through our platform or machines are subject to availability. Prices are displayed in GBP (£) and are inclusive of VAT where applicable. Payment is taken at the point of order. We reserve the right to cancel any order in the event of a system error, stock unavailability, or suspected fraudulent activity.
Payment is processed by Stripe (UK/international) or Paystack (Nigeria), depending on your location. All payments are secure and encrypted.
4. Refunds and Cancellations
If a machine fails to dispense your order after payment, you are entitled to a full refund. Refund requests must be submitted via our support system or by contacting us directly. We aim to process refunds within 5–10 business days.
Pre-orders may be cancelled before collection. Once a release code has been used and a smoothie dispensed, the order cannot be refunded.
5. Release Codes
Release codes issued for pre-orders are single-use and time-limited. Codes expire as indicated on your order confirmation. HenovaFresh is not responsible for expired or lost codes. Keep your release code secure and do not share it with others.
6. Loyalty Points
Loyalty points are awarded at our discretion and have no cash value. We reserve the right to modify, suspend, or terminate the loyalty programme at any time with reasonable notice.
7. Acceptable Use
You agree not to:
- Use our platform for any fraudulent, unlawful, or harmful purpose
- Attempt to interfere with the operation of our machines or software
- Misrepresent your identity or provide false information
- Scrape, copy, or redistribute our platform content without permission
8. Intellectual Property
All content on the HenovaFresh platform, including brand names, logos, images, and software, is the intellectual property of HenovaFresh Ltd. You may not reproduce or use any content without our written permission.
9. Limitation of Liability
To the maximum extent permitted by law, HenovaFresh Ltd is not liable for any indirect, incidental, or consequential damages arising from your use of our services. Our total liability for any claim arising from use of our services shall not exceed the amount paid for the specific order in question.
10. Allergens and Health
Allergen information is provided for each product on our menu. It is your responsibility to check allergen information before purchasing. If you have a severe food allergy, please contact us before ordering. HenovaFresh cannot guarantee that products are free from trace allergens.
11. Changes to These Terms
We may update these Terms at any time. Continued use of our platform after changes are posted constitutes acceptance of the updated Terms. We will notify users of material changes via email.
12. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
